In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) (“DMCA”), we have designated a Copyright Agent and established the following procedures for reporting and responding to copyright infringement claims.

If you believe that content available on or through LoyalClip infringes your copyright, you may submit a written notification (a “DMCA Takedown Notice”) to our designated agent above. To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
Incomplete notices will not be processed. We may contact you to request missing information.
Upon receiving a valid and complete DMCA Takedown Notice, LoyalClip will act expeditiously to: (a) remove or disable access to the allegedly infringing content; and (b) notify the user who posted the content (to the extent we have their contact information).
If you believe that content you posted was removed or disabled in error as a result of a DMCA Takedown Notice, you may submit a “Counter-Notice” to our designated agent. Under 17 U.S.C. § 512(g)(3), a valid counter-notice must include:
Upon receipt of a valid counter-notice, LoyalClip will forward it to the original complainant and, unless the complainant files a court action within 10–14 business days, we will restore the removed content at our discretion.
LoyalClip has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A “repeat infringer” is a user who has been notified of infringing activity more than twice and/or has had content removed from the platform more than twice.
Account termination under this policy is in addition to any other legal remedies LoyalClip may pursue. Nothing in this policy limits our right to take action against a user for a single act of infringement.
The DMCA provides that any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages (including attorneys’ fees) under 17 U.S.C. § 512(f). LoyalClip takes misuse of the DMCA process seriously and will pursue appropriate remedies if we receive knowingly false notices.
